<p style="text-align: left;" align="center">Baltimore, MD &#8212; Yesterday, members of the Senate introduced the highly anticipated bill to reform immigration policy in the United States. Centro de los Derechos del Migrante, Inc. (CDM; Center for Migrant Rights, in English), a transnational migrant legal rights organization that defends the rights of internationally recruited workers and other migrants, has been diligently reviewing the proposed legislation to determine how it will impact the workers whose interests we serve.</p>
<p style="text-align: left;">&#8220;This bill comes at an historic moment,&#8221; said Sarah Rempel, policy attorney at CDM, &#8220;Congress has the opportunity and the responsibility to create a just and fair immigration system that protects and promotes human dignity.&#8221;</p>
<p style="text-align: left;">For years, CDM has been working with migrant workers in Mexico and the United States to protect their labor and human rights. During this time, we have uncovered widespread abuses throughout the process, including in the recruitment of these workers.  CDM has published <a href="http://www.cdmigrante.org/publications/">several reports</a> in the past few months documenting many of these abuses, including recruitment fraud, discrimination and wage theft, among others.</p>
<p style="text-align: left;">&#8220;This bill includes crucial provisions that address the widespread recruitment abuses that CDM has documented,&#8221; said Rachel Micah-Jones, CDM&#8217;s Executive Director. &#8220;The proposal introduced yesterday is a first step in ensuring that migrant workers&#8217; rights are protected and defended.&#8221;</p>

<p style="text-align: left;">Baltimore, MD &#8212; Ayer, miembros del Senado presentaron el anhelado proyecto de ley para reformar la política migratoria de los Estados Unidos. El Centro de los Derechos del Migrante, Inc. (CDM; Center for Migrant Rights, en Ingles), una organización transnacional enfocada en la defensa legal de los derechos de trabajadores migrantes reclutados internacionalmente y otros migrantes, ha estado revisando la propuesta de ley para determinar como impactará a aquellos trabajadores cuyos intereses servimos.</p>

<p>&#8220;Este proyecto de ley llega en un momento histórico&#8221;, dijo Sarah Rempel, abogada del CDM, &#8220;el Congreso tiene la oportunidad y la responsabilidad de crear un sistema migratorio justo que proteja y promueva la dignidad humana&#8221;.</p>
<p>Por años, el CDM ha colaborado con trabajadores migrantes en México y los Estados Unidos para proteger sus derechos laborales y humanos. Durante este tiempo, hemos descubierto abusos endémicos a lo largo del proceso, incluyendo en el reclutamiento de trabajadores. 				<content:encoded><![CDATA[<p>(Baltimore, MD &#8211; April 17, 2013)&#8211;Centro de los Derechos del Migrante, Inc. (CDM), acknowledges the Senate’s introduction of a bill to reform immigration policy in the United States and salutes the advocates and migrant leaders who have raised their voices in this critically important debate. “This bill comes at an historic moment,” said Sarah Rempel, policy attorney at CDM, “Congress has the opportunity and the responsibility to create a just and fair immigration system that protects and promotes human dignity.”  CDM believes these efforts are an essential first step in achieving justice for migrant workers, especially the provisions that create a roadmap to citizenship for the 11 million aspiring Americans in the United States.</p>
<p>The bill reforms the employment-based visa system to include some additional worker protections, including critical safeguards against recruitment abuse.  Abuses in the international labor recruitment process currently affect workers across labor sectors who come to the United States on employment-based visas.  In worst-case scenarios, unscrupulous employers traffic workers into the United States. The provisions in the Senate bill would improve transparency and accountability in foreign labor contracting and help prevent recruitment abuse. The Senate bill would also create a W visa category that would allow workers to change employers, an important protection for those who experience abuse on the job.</p>
<p>The Senate bill is an important first step in creating a just and fair immigration system. CDM will be closely analyzing the bill’s lengthy and complicated provisions to determine how it will impact the workers whose interests we serve.  CDM’s in-depth analysis of the bill will be forthcoming in the next day.</p>

<p>Thousands of immigrants, advocates, and allies will meet today in Washington D.C. to call for fair and inclusive immigration reform. As a transnational organization dedicated to the defense and promotion of migrant rights in the U.S., Centro de los Derechos del Migrante, Inc. (CDM) will be at today’s rally to advocate for swift immigration reform. We stand in solidarity with the millions of immigrants and migrant workers in the U.S. and call upon Congress to create an immigration process that includes a broad path to citizenship, family unity provisions and strong labor protections, such as:</p>
<p>· Justice in recruitment—A thorough overhaul of the work visa program to address recruitment abuses is needed. Reforms must address discrimination in recruitment, illegal fees, and the lack of regulation and accountability of foreign labor recruiters. Transparency in the recruitment process is needed to protect workers from fraud and unscrupulous recruiters.<br />
· Access to justice and protections from retaliation—Many migrant workers are afraid to voice their complaints out of fear of losing their jobs and visas. Ensuring employment mobility for migrant workers is important to prevent retaliation. Policies must also allow workers to follow through with their cases in the U.S.<br />
· Fair wages and safe working conditions.</p>
<p>CDM encourages President Obama and members of Congress to pass comprehensive immigration reform that includes a broad path to citizenship, family unity provisions, and important worker protections. The time for immigration reform is now!</p>

<p style="text-align: center;"><strong>Farmworker Women Join the Immigration Conversation</strong></p>
<p>A delegation of more than 60 farmworker women leaders and advocates will meet in Washington, D.C. from April 6 through the 10, 2013 to educate members of Congress about farmworker women&#8217;s unique concerns related to the United States&#8217; broken immigration system, including issues related to family separation, discrimination against internationally recruited women workers, and the current anti-immigrant sentiment that exists in the United States. The women are members of <em>Alianza Nacional de Campesinas</em> (National Farmworker Women&#8217;s Alliance, in English;<em> Alianza de Campesinas</em>). Members will be traveling from Florida, Arizona, California, Maryland, New Mexico, New York, Oregon and Texas to participate.</p>
<p>&#8220;This is a very important moment in history,&#8221; said Mily Trevino-Sauceda, President of <em>Alianza Nacional de Campesinas</em>. &#8220;Farmworker women are often left out of the conversation about topics like immigration and workers&#8217; rights. We are convening in DC to make sure that we have a chance to educate people about farmworker women&#8217;s concerns.&#8221;</p>
<p><em>Alianza de Campesinas</em> members will also meet with federal agency officials, students and members of the public to educate them about the most pressing concerns impacting farmworker women and their families. The delegation will address gender violence against female migrant workers, employment abuses, immigration concerns, pesticide exposure, other health priorities and safety issues.</p>
<p>&#8220;We have been organizing for months in order to make this important trip,&#8221; said Diana Bustamante, Delegate to <em>Alianza de Campesinas</em>. &#8220;Even though it is difficult for many of our members to miss work, find child care and travel to DC, we feel that we have a responsibility to ourselves, our families and our communities to inform the general public about the plight of farmworkers in the U.S.&#8221;</p>
<p>Members met in D.C. in October 2012 to officially launch <em>Alianza de Campesinas</em>. In addition to identifying immigration as one of their priority areas, members are also concerned about economic justice, equality, health and safety for all U.S. agricultural workers.</p>

<p><em>Alianza Nacional de Campesinas</em> was formed in 2011 after many years of conversations with farmworker women around the United States and in Mexico. <em>Alianza de Campesinas</em>&#8216; mission is to unify the struggle to promote farm worker women&#8217;s leadership in a national movement to create a broader visibility and advocate for changes that ensure their human rights.</p>
<p>The organization is comprised of current or former farmworker women, along with women who hail from farmworker families. Members represent the following organizations: Campesinos Sin Fronteras, Centro de los Derechos del Migrante, Inc., Colonias Development Council, Farmworker Association of Florida, La Mujer Obrera, Organización en California de Líderes Campesinas, Pineros y Campesinos Unidos of Oregon (PCUN), the Rural Coalition and Tierra del Sol Housing Corporation, among others. In addition, several key groups have been instrumental in providing support and planning for <em>Alianza de Campesinas</em>&#8216; delegation to DC, including Earthjustice, Farmworker Justice, Georgetown University, the Rural Coalition, representatives of the US Department of Agriculture and other federal agencies.</p>

<p style="text-align: left;"><span style="text-align: left;">Una delegación de mas de 60 líderes campesinas y defensores se reunirán en Washington DC del 6 al 10 de Abril del 2013 para educar a miembros del Congreso sobre los temas que preocupan particularmente a campesinas en torno a las fallas en el sistema migratorio de los Estados Unidos, incluyendo cuestiones relacionadas a la separación de familias, discriminación contra trabajadoras reclutadas internacionalmente y el sentimiento anti-inmigrante que existe actualmente en los Estados Unidos. Las mujeres son miembros de la <em>Alianza Nacional de Campesinas</em> (también conocida como <em>Alianza de Campesinas</em>). Miembros viajarán desde Florida, Arizona, California, Maryland, Nuevo México, Nueva York, Oregón y Texas para participar.</span></p>

<p>La <em>Alianza Nacional de Campesinas</em> se formo en el 2011 después de muchos años de conversaciones entre campesinas en los Estados Unidos y México. La misión de la <em>Alianza de Campesinas</em> es el unificar la lucha por promover el liderazgo de campesinas en un movimiento nacional para visibilizar mas este tema y abogar a favor de cambios que garanticen sus derechos humanos.</p>
<p>La organización es constituida por campesinas y ex-campesinas, junto con mujeres de familia campesina. <p align="center"><strong>Federal Court Orders the U.S. Department of Labor to Stop Using Invalid Wage Determinations for Temporary Workers</strong></p>
<p><strong>BALTIMORE, MD-</strong> Centro de los Derechos del Migrante, Inc. (The Center for Migrant Rights, or “CDM”) is celebrating a victory in the case <em>Comité de Apoyo a los Trabajadores Agricolas (CATA) v. Solis, et al., </em>Civil No. 2:09-cv-240-LP, 2010 WL 3431761 (E.D. Pa.).  In response to litigation by CDM and co-counsel Edward Tuddenham, Friends of Farmworkers, Inc., North Carolina Justice Center, Northwest Workers’ Justice Project, and the Southern Poverty Law Center, on March 21, 2013 the U.S. District Court for the Eastern District of Pennsylvania said the Department of Labor (DOL) could no longer use the 2008 invalid wage methodology, which artificially lowers wages so that they no longer represent the market rates.  This decision was issued on the same day that Congress passed a financial plan that continued to block funding for the 2011 prevailing wage rule.  The 2011 prevailing wage rule, if funded, would make wages for many temporary workers consistent with market wages.  The federal court ordered the DOL to come into compliance within 30 days of the ruling.</p>
<p>“By continuing to use the 2008 wage rate calculations, the administration significantly limited workers’ abilities to earn competitive wages in U.S. seasonal industries,” said Rachel Micah-Jones, CDM’s Executive Director. “We were forced to take action against the DOL to ensure a fair wage for the thousands of workers who labor on H-2B visas.  We are pleased that the Court decided ‘enough is enough’ and prohibited the use of a wage methodology that, while still in use, was declared invalid on August 30, 2010.”</p>
<p>CDM with a coalition of immigrants’ rights defenders initiated a federal lawsuit against the DOL on behalf of Salvador Martinez Barrera, a leader of CDM’s Comité de Defensa del Migrante (Migrant Defense Committee), and other workers to challenge the regulations that were issued at the twilight hour of the Bush Administration. Beginning in 2009, the coalition represented plaintiffs against U.S. Secretary of Labor Hilda Solis, Alexander J. Passantino, Janet Napolitano and the U.S. Department of Homeland Security.  The lawsuit alleged that the assigned prevailing wage rates artificially lowered temporary workers’ pay below market rates and jeopardized migrant and U.S. workers’ rights.</p>
<p>“This is a very significant step forward for internationally recruited workers who come to the U.S. on H-2B visas,” said Micah-Jones.  “The Court’s ruling brings us closer to ensuring that workers earn the pay that they deserve for all of the hard work that they perform.”</p>

<p align="center"><strong>Tribunal Federal Ordena al Departamento de Trabajo de los Estados Unidos Dejar de Usar un Sistema Invalido para Calcular los Salarios de Trabajadores Huespedes</strong></p>
<p><strong>BALTIMORE, MD- </strong>El Centro de los Derechos del Migrante, Inc. (CDM) celebra un triunfo en el caso <em>Comité de Apoyo a los Trabajadores Agrícolas (CATA) v. Solis, et al., </em>Civil No. 2:09-cv-240-LP, 2010 WL 3431761 (E.D. Pa.). Respondiendo a la demanda del CDM y abogados co-defensores Edward Tuddenham, Friends of Farmworkers, Inc., North Carolina Justice Center, Northwest Workers’ Justice Project, y Southern Poverty Law Center, el 21 de Marzo del 2012 el Tribunal Federal de Distrito para el Distrito Este de Pennsylvania dijo que el Departamento de Trabajo (DOL, por sus siglas en inglés) no podrá seguir usando la metodología invalida del 2008 para calcular salarios, la cual reduce salarios artificialmente de manera que no representan la tasa del mercado. Esta decisión fue publicada el mismo día en el que el Congreso aprobó un plan financiero que continuará bloqueando fondos para la regla de salarios prevalecientes del 2011. La regla de salarios prevalecientes del 2011, si fuese financiada, lograría que los salarios para muchos de los trabajadores huéspedes sean consistentes con los salarios del mercado. El tribunal federal ordenó al DOL cumplir con la regla a 30 días del fallo.</p>
<p>“Al continuar el uso del sistema del 2008 para calcular salarios, el gobierno limitó considerablemente la capacidad de los trabajadores de ganar salarios competitivos en las industrias estadounidenses temporales”, dijo Rachel Micah-Jones, Directora Ejecutiva del CDM. “Nos vimos forzados a tomar medidas contra el DOL para asegurar un salario justo para los miles de trabajadores que trabajan con visas H-2B. Nos da gusto que el Tribunal dijó ‘¡ya basta!’ y prohibió el uso del sistema para calcular salarios que, aunque todavía se usa, fue declarado inválido el 30 de Agosto del 2010”.</p>
<p>El CDM y una coalición de defensores de derechos de los migrantes entablo una demanda federal en contra del DOL en nombre de Salvador Martinez Barrera, uno de los líderes del Comité de Defensa del Migrante del CDM, y otros trabajadores para desafiar las reglas que fueron publicadas en las ultimas hora de la presidencia de Bush. Empezando en el 2009, la coalición represento a los demandantes contra la Secretaria del Trabajo de los Estados Unidos Hilda Solis, Alexander J. Passantino, Janet Napolitano y el Departamento de Seguridad Nacional de los Estados Unidos. La demanda afirma que las tasas de salarios prevalecientes asignados redujeron de manera artificial la nómina de trabajadores temporales por debajo de las tasa del mercado y pusieron en peligro los derechos de trabajadores migrantes y estadounidenses.</p>
<p>“Este es un paso importante para los trabajadores reclutados internacionalmente quienes vienen a los Estados Unidos con visas H-2B,” dijo Micah-Jones. “El fallo del Tribunal nos acerca a un punto en el cual podremos asegurarnos que los trabajadores ganen el sueldo que merecen por todo el trabajo duro que realizan”.</p>
